• Advertising – website and literature

The extent to which you, as a the trader, advertise/present your connection with conducting your business at an Event alongside your normal trading premises will have a bearing on whether a contract that you conclude with a Consumer will be regarded as ‘on premises’ (i.e. disentitling the Consumer of cancellation rights within a cooling off period from the date of concluding the contract).

If you are trading at an Event (whether as manufacturer, manufacturer’s appointed dealer or agent) we suggest that you include on your website/marketing materials/stationery etc. details of your usual concession at such Events on a regular basis, such as:-

  • • Also trading at the Caravan, Camping & Motorhome Show 2017 (Stand number 3170), which takes place at the NEC, Birmingham, B40 1NT in February ” or
  • • “Please also visit us at our usual stand (Stand number 3170 at the NEC…”

This may be persuasive to a court in defining a contract concluded at such an event as ‘onpremises’
